Paragard IUD Lawsuits: Q&A With Attorney Trent Miracle

Thousands of women are suing CooperSurgical, the makers of the Paragard copper IUD, alleging that the device may break upon removal. This can cause complications like infertility and pain. In some cases, women have needed surgery to remove the device’s broken pieces.
There have been no settlements or jury verdicts in the litigation yet, but the first bellwether trial is set for early 2026. Two others will follow in March and May of 2026.
In this Q&A, mass tort litigation attorney Trent Miracle discusses why people are suing CooperSurgical, what injuries are at the center of the litigation and what to expect if you file a Paragard lawsuit in 2025.
Q: What is Paragard, and why are people filing lawsuits?
Paragard is a long-term birth control known as an IUD. It’s placed in the uterus. Paragard releases copper into the uterus to prevent pregnancy. It doesn’t release hormones like other IUDs.
The FDA has received thousands of reports of the Paragard device unexpectedly breaking inside the uterus, migrating out of position or causing perforation of the uterus. In many of these cases, women were severely injured or required surgery as a result.
Q: What are some of the injuries people are claiming?
In most instances, lawsuits arise out of some type of fracture involving Paragard, resulting in injuries ranging from minor scarring of the uterus to the inability to have children and all the way to a full hysterectomy.
Q: What is the reason Paragard is breaking upon removal?
The Paragard device can break during removal due to an alleged design flaw in which the plastic arms become brittle and fracture inside the uterus. Such fractures can result in the plastic becoming embedded in the uterus, requiring removal surgery.
Q: How can people qualify to file a Paragard lawsuit?
If you had complications related to the removal of your Paragard IUD, you should contact an experienced medical device attorney to discuss your options.
Q: What is the status of the litigation and any upcoming trials?
Compared historically to other medical device cases, Paragard litigation is at an advanced stage. Trials are currently scheduled to begin in early 2026, and with trials comes pressure on both sides to seek a global resolution to avoid the time, expense and uncertainty of reaching a jury verdict.
Q: How have you seen Paragard complications affect your client’s lives?
We have complications related to Paragard removal that absolutely shatter the lives of our clients, not to mention their husbands and families. The injuries can be profound, and the impacts on their reproductive health can be permanent.
