Key Covidien Hernia Mesh Lawsuit Trial Begins With Thousands of Other Cases Waiting
A key trial over claims that defective hernia mesh led to severe health issues is now underway. That trial will be closely watched, as it is the first involving Covidien mesh to go before a jury.
More than 2,400 similar Covidien hernia mesh lawsuits have been grouped together in federal court. These cases were filed by people who say that they suffered serious issues like bowel obstruction or the need for revision surgery after their hernias were treated with Covidien’s products.
This early case is known as a bellwether trial, since its outcome could have a big impact on the thousands of other pending cases. Bellwether trials help both sides test the strength of their arguments without having to take hundreds or thousands of individual cases to trial.
If people who have filed lawsuits win early trials, it could spur settlement talks for other cases.
The trial that began this week involves a man who received Covidien mesh as part of a hernia repair surgery in 2017. By 2020, he required another surgery after experiencing bowel obstruction.
Some of his small bowel was removed in a spot where it was stuck tightly to the mesh.
The man claims that Covidien’s product was defectively designed and that the company failed to warn of serious risks tied to its use.
More bellwether cases are expected to go before juries after this trial is completed.
Tens of Thousands of Hernia Mesh Lawsuits Claimed Companies Sold Defective Products
Covidien is not the only company facing lawsuits over hernia mesh complications. C.R. Bard and Johnson & Johnson’s Ethicon have also faced thousands of lawsuits over similar claims.
Becton Dickinson, which purchased C.R. Bard, agreed to a settlement for about 38,000 hernia mesh lawsuits in 2024. J&J has also settled thousands of hernia mesh cases.
New hernia mesh lawsuits continued to be filed by people who say they were impacted.
