Thousands of hernia mesh lawsuits have entered a critical stage following a landmark verdict. Last month, medical device giant Medtronic was ordered to pay $88 million to a man who said he needed emergency surgery after his bowel became stuck to his hernia mesh.

That case was one of nearly 2,500 claiming that Covidien hernia mesh, used in hernia repair surgeries, is defective and led to serious complications.

With another trial scheduled for January, the stakes are high.

Could a Covidien Hernia Mesh Settlement Be Coming?

The recent Covidien trial that resulted in an $88 million verdict was important, partially because it was the first bellwether trial in the litigation.

Bellwether trials are often used when thousands of similar lawsuits are filed. It’s not realistic for all of those individual cases to be prepared for trial, so a small group of lawsuits is selected to go through that process as a reflection of the larger litigation.

This means that the outcome of the bellwether trials can have wide-ranging implications, with the fate of thousands of other cases tied to its result.

When companies face significant bellwether losses in dangerous product lawsuits, they are often encouraged to negotiate a global settlement.

The $88 million loss was significant. It was a sizable verdict, and thousands of other cases remain active. If Medtronic were to be hit with another major verdict in the upcoming January trial, it could spur settlement negotiations.

Past Hernia Mesh Settlements Result in Payouts for Thousands

Covidien is not the first hernia mesh brand to face significant legal scrutiny over potential defects and injuries. Ethicon and C.R. Bard hernia mesh were both subjects of thousands of these lawsuits.

Many of these were eventually resolved via settlements. In 2024, Bard’s owner, Becton, Dickinson and Company, announced that it had reached an agreement in the vast majority of the tens of thousands of hernia mesh lawsuits involving its products.

Ethicon similarly settled many hernia mesh claims involving its Physiomesh as lawsuits mounted.

Covidien remains one of the final major active hernia mesh litigations.
